Authorize the County Manager to modify the United States Marshals Service Intergovernmental Agreement (IGA) No. 36-99-0088 to reflect the exclusion of Immigration and Customs Enforcement (ICE) detention at the Cumberland County Jail.

Background and Purpose of Request
For close to a year, the County Commissioners have received requests from citizens to remove the County out of the federal contract for the holding of ICE inmates at the County Jail. The Commissioners have had a series of meetings over the last year to hear concerns and learn about the contract arrangement. Commissioners have also explored the legality of the holding of all public safety inmates at the county jail as it applies to State Statute and MDOC Mandates and have continued to track a few legislative bills this year that would play a role in the legality of holding federal inmates.
Recently, staff have been in contact with third-party consultants, who have handled similar amendments and have been provided guidance, on how to approach such an amendment. A draft letter has been created for Commissioner review.
The Commissioners have instructed staff to place the Marshals contract on the April 21st meeting for Commissioner consideration.
